Education Department Begins Process to Implement HEA Reauthorization with New Campus Safety Provisions
Phillips, Lisa
Campus Law Enforcement Journal, v38 n5 p25, 27 Sep-Oct 2008
The U.S. Department of Education has announced the beginning of the process to develop rules for new requirements in the recently passed Higher Education Act (HEA). Highlights of the HEA that affect campus public safety departments include measures that: (1) Require a fire log be maintained at an institution of higher education for events that cause damage to property or person; (2) Add four new categories of crime under hate crimes reporting; (3) Require an institution to establish a plan for establishing contacts for students who are missing for 24 hours, if those students opt into the system; and (4) Require an emergency plan for law enforcement, man-made and natural disasters and plans for notification of students, staff and faculty of that emergency. The Department scheduled six public hearings for interested parties to discuss the agenda for the negotiated rulemaking session. The aim of negotiated rulemaking is to reach consensus on the best way to offer guidance in following this new law.
