Ireland has recently achieved its own landmark with the appointment of its first Ombudsman for Children, Ms. Emily Logan. The Ombudsman was signed into her office by the President on 18 December 2003 for a term of 6 years pursuant to the Ombudsman for Children Act 2002 (the 2002 Act). One of the purposes of the office of Ombudsman is the co-ordination and improved delivery of children's services and the vindication of children's rights. The establishment of that office is in recognition of the need for an independent person to act as an advocate for children in promoting their welfare and rights reflecting the emerging consensus that children can be holders of certain rights which can be enforceable in law. While the office of the Public Services Ombudsman is empowered to investigate "action[s] taken in the performance of administrative functions", the main functions of the Ombudsman for Children (the Ombudsman hereafter) is to promote the rights and welfare of children and to investigate individual complaints, made by or on behalf of children, arising in the course of the administration of public bodies, recognized schools or public hospitals.
