Discipline and the Section 504 Student: Your Quick-Reference Guide to Best Practices.

This document is intended to provide guidance to schools in the discipline of students with disabilities in compliance with regulations under Section 504 of the Rehabilitation Act of 1973. Chapters address the following topics (sample sub-topics in parentheses): (1) basics of discipline under Section 504 (common mistakes districts make when disciplining Section 504 students and limits on a districts choice of disciplinary sanctions for students with disabilities); (2) manifestation determinations (the process under Section 504 and the Individuals with Disabilities Education Act and how the courts view manifestation documentation); (3) suspensions and expulsions (protections that Section 504 provides for student removals and determination of whether conduct is disability related); (4) significant changes in placement (when a disciplinary action becomes a significant change in placement and Section 504 and the stay-put provision); (5) drugs and alcohol (student drug abuse ends Section 504 services and discipline of students with alcoholism); (6) managing student behavior (classifying students with social maladjustment and behavior management of students with attention deficit hyperactivity disorder); and (7) handling serious disciplinary actions (applying the Gun Free Schools Act to Section 504 students). The final chapter summarizes 23 legal cases relevant to the discipline of students with disabilities. (DB)
