The fourth in a series on implementation and enforcement of major civil rights laws relating to Americans with disabilities, this report looks at how such enforcement relates to electronic and information technology. As used in this report, Electronic and Information Technology (E&IT) particularly involves the Internet, the World Wide Web, and select information/transaction machines. The study analyzed all relevant statues, regulations, and case law bearing on the scope and enforcement of disability civil rights laws, interviewed key federal officials involved in the process of making E&IT accessible, reviewed federal documentation of accessibility policies and practices, and analyzed nongovernmental reports and studies of E&IT accessibility. Findings indicate that individual leadership and commitment on the part of officials and staff, particularly federal agencies, largely accounts for the relative success in implementing pro-accessibility measures. A corollary finding is that institutionalization of these practices and policies remains tenuous but is both necessary for and aided by the emergence of new leadership. Ten recommendations are made, including: (1) incorporate E&IT accessibility into the agency planning and government-wide planning processes at all levels; (2) review the federal contracting process to encourage diffusion of accessibility; and (3) establish federal Web site quality control.
