This document addresses nondiscrimination on the basis of age in programs or activities receiving federal financial assistance. It consists of the amendments made in the notice of Final Regulations published in the Federal Register on November 13, 2000. Its purpose is to set out the Department of Education's rules for implementing the Age Discrimination Act of 1975. The act, which prohibits discrimination on the basis of age in programs or activities receiving federal financial assistance, does permit federally assisted programs or activities and recipients of federal funds to continue to use age distinctions and factors other than age that meet the requirements of the act. The amendment is divided into four parts: (1) general; (2) standards for determining age discrimination; (3) duties of Department of Education recipients; and (4) investigation, conciliation, and enforcement procedures. Section 1 examines the purpose of the age-discrimination legislation and discusses the programs affected by the legislation. Section 2 looks at exceptions to the rules against age discrimination, burden of proof, and special benefits for children and the elderly. Section 3 outlines general responsibilities, information requirements, and recipient assessment of age distinction. The last section details compliance reviews, complaints, mediation, investigation, prohibition against intimidation or retaliation, and remedial action by recipients. (RJM)
