The 1999 IDEA Regulations: A Practical Analysis.

This publication explains how some of the more significant 1999 regulations of the Individuals with Disabilities Education Act will affect schools providing services to children in need of special education. The analysis tracks the regulatory format used to organize the rules under Title 34 of the Code of Federal Regulations. The selected provisions are identified by the rule number assigned by the Department of Education and are set forth in sequential order. The text of each provision selected is reprinted verbatim followed by a description of its conformance to the statute and any significant changes made from the proposed rule. An analysis is provided to point out legal issues that the regulation raises from the school district's perspective and to offer practical suggestions on how schools should ensure compliance with the regulations and the statute. Analyzed provisions include those relating to: assistive technology, free appropriate public education, the Individualized Education Program, placement of children in private schools and provision of special education services, change of placement for disciplinary removals, disciplinary protections for children not yet eligible for special education, and referral to and action by law enforcement.
