Litigation over the rights of handicapped students and employees continued at a significant level during 1989. Recovery of attorneys' fees was the most frequently litigated handicapped issue. Cases are summarized under the following topics: (1) entitlement to services; (2) procedural safeguards, including change in placement, administrative remedies, standing to sue, and statute of limitations; (3) placement, including appropriate educational program, least restrictive environment, and private facilities; (4) related services; (5) discipline; (6) remedies; (7) state immunity; (8) other Education of the Handicapped Act (EHA) issues; (9) state laws; and (10) discrimination under the Rehabilitation Act, Section 504.
