Sport Law. NOLPE Monograph Series, No. 40.
Sharp, Linda A.
Three primary areas of concern for those who confront sport law matters in public school or collegiate settings are the focus of this monograph. The first chapter presents tort issues, primarily negligence. A brief overview of fundamental negligence concepts is followed by discussions of major risk areas: supervision, conduct of the activity, and equipment and facilities. A review of the principles of risk management recommends use of a preventative approach. The second chapter discusses basic principles of contract law and concerns of sports administrators, with a focus on varieties of contract agreements. The final chapter reviews principles of constitutional law as applied to sport settings. Freedom of speech and religion, drug testing, due process, and sex discrimination are discussed. A selective list of cases in included. (LMI)
