Private College Faculty as Managers: An Epmirical Test under "Yeshiva." ASHE 1986 Annual Meeting Paper.

The validity of the U.S. Supreme Court's assertion that faculty members performed certain tasks that made them managers in the case of "National Labor Relations Board v. Yeshiva University" was examined. The following concerns were addressed: whether faculty authority varies between Liberal Arts I and Liberal Arts II colleges, as defined by the Carnegie classification; and whether the perception of faculty authority varies depending on the position the observer holds. The survey instrument, which is appended, was based on the 1969-1970 study conducted by a Committee of the American Association of University Professors. Of 955 questionnaires mailed to staff at 75 Liberal Arts I and 75 Liberal Arts II colleges, 478 usable responses were received from board chairpersons, presidents, chief academic officers, deans, and department chairpersons. The findings confirm the validity of the court decision. The legal standard for determining whether staff members are managers is that they make or effectively recommend policy in certain areas. Faculty members were found to made decisions. Also found were formal mechanisms to elicit faculty opinion and a requirement that administration and faculty concur on decisions. Perceptions of faculty authority varied among the two types of colleges and among the different staff surveyed. (SW)
