Another in the Contemporary Legal Education Series, this book questions how the law and the legal system have contributed to the support or destruction of separatist tendencies "in a context where there has been a rather formal debate on the precise issues of assimilation and preservation of cultural identity". The book is designed (1) to complement Felix Cohen's text, the "Handbook of Federal Indian Law", (2) to spur an increase of the study of Indian legal problems, (3) to provide an accurate assessment of such problems as a necessary supplement to college level American history course material, and (4) to provide useful and practical material for Indian people and their lawyers to increase the more effective use of the law by those parties. The chapters provide a detailed examination of five broad topics: Sovereignty and the Flow of Power; Power of the States; Concepts of Property in Federal Indian Law; Land Tenure, Land Use, and Economic Development; and Strengthening Tribal Government. Each topic is illustrated and supported by pertinent notes and cases, and the approximately 500 cases cited are listed alphabetically in a Table of Cases. Finally, there is a bibliography of about 200 Law Review articles related to Indian affairs. The bibliography is organized by subject. (Author/SB)
