Two basic questions underlie school law battles: Who governs public education? What are the limits of the school board's power? Examples can be seen in litigation regarding questions such as State-local responsibility in school finance and assessment, the public release of district-wide test scores, the authority of arbitrators to make educational policy determinations, the extent to which managerial power can be bargained away, the power of public colleges to impose tenure quotas, and a State-wide teachers' union's right to represent in collective bargaining the professional staff of a State department of education. Specific cases relating to school board power and authority, school board duties, school board membership and elections, school district organization, control of building and grounds, service contracting, and tort liability for a muisance are presented and discussed in this chapter.
