A number of currently available texts, supplementary books, and monographs dealing with legal issues in higher education are critically reviewed for their possible use in courses on higher education law. Generally, only materials written since the 1970s are considered. (MSE)

Using various primary data sources regarding the character of judiciary activities since the early 1800s, this article examines the charge that the U. S. Supreme Court has become increasingly "imperial," with judges despotically usurping and exercising power. Data analysis fails to support this claim. (JDH)

The process by which constitutional and trust law have blended together in the charitable trust field is examined. Focus is on whether a settlor can expect racial and religious restrictions in a charitable trust to be allowed, how to deal with them if they are, and what happens to the trust property if they are not. The Hiscott decision indicates that the court will require notice to meet specific standards before an individual's right to maintain a civil action under the ADEA becomes operative. It also suggests that strict compliance with the 180-day notice provision will continue to be a condition precedent to suit. (Author/LBH)

A conceptual clarification of the constitutionally protected right of fair use, a resultant reformulation of some basic copyright law principles, and a contribution to the survival of the copyright system itself are discussed. (LBH)

A problem unique to constitutional torts arises when state-created governmental entities are defendants. Implications of the problem are discussed, and it is concluded that until the issue is resolved, the right to compensation for violations of rights will continue to depend upon the law of the state in which the violation occurred.
