Dick and Jane Hire a Lawyer: A Case-Based Examination of How Business Professionals Can Work Effectively with Legal Counsel
Nersessian, David L.
Journal of Legal Studies Education, v37 n2 p123-160 Sum 2020
This article details a teaching exercise developed for use in core business law courses for undergraduates and Master of Business Administration (MBA) students. The exercise has two primary goals. First, if conducted toward the end of the course, it allows for the substantive review of several primary areas of business law such as business organizations, intellectual property, contracts, and agency. This reinforces learning and enables students to see how these issues overlap and intersect with one another in the entrepreneurial context of a start-up business. Second, the exercise facilitates a dialogue around how business professionals work with lawyers in practice. This helps students to better understand the attorney-client relationship, the pragmatic issues that can arise in legal representation, and the ethical responsibilities of both counsel and clients. It also provides them with a basic understanding of their rights as clients and what they reasonably can expect as future purchasers of legal services in the business context.
