Current Issues in Eligibility Decisions for Students with ADHD: What the Courts Say

Children with attention deficit hyperactivity disorder (ADHD) may experience educational difficulties that warrant an evaluation to determine whether they are eligible to receive services under the Individuals with Disabilities Education Act (IDEA). As with any disorder, legal disputes about eligibility sometimes arise between parents and school districts. Based on a recent systematic study of court decisions about eligibility for students with ADHD, the case scenario and discussion presented in this paper highlights selected recurring issues that are of practical significance for school psychologists.
